Last Monday, a marathon four-hour court session unfolded at the N’Djamena Court of Appeal. The defendant, accused of selling a single parcel to multiple investors for millions of CFA francs, also faces allegations of issuing death threats against those who demanded refunds.

Prosecutors allege the defendant collected payments ranging from 52 million to 99.5 million CFA francs from various buyers, all claiming ownership of the same property. The courtroom erupted in heated exchanges between the defense team and civil counsel, who are demanding full reimbursement plus compensation for their clients.

The defense argued their client had been unlawfully detained for over three months by intelligence services before being brought to court. They maintained the land rightfully belongs to their client, who acts as a representative for his brothers, and insisted it was never legally contested. The defense pointed to manipulation by a paternal uncle who allegedly pressured family members to stake claims on behalf of the deceased brother, triggering the current legal dispute.

Civil counsel labeled the defendant’s actions as clear fraud, an accusation the defense vehemently denied, asserting no fraudulent transfers occurred and that relevant penal codes do not apply in this scenario. The prosecution countered by requesting a conviction, emphasizing that collecting large sums from multiple parties constitutes a criminal offense, and sought a 500,000 CFA franc fine.

Both sides presented compelling arguments as judges deliberate. Notably, an identical case was heard on June 1st, where the same defendant faced similar charges. The court has since adjourned the matter for further deliberation, with the accused remaining in custody at the Klessoum detention facility pending a final verdict.
