In early August, Joseph Kabila formally approached the US judiciary with the objective of removing his name from the black list maintained by the Office of Foreign Assets Control (OFAC). This division of the Treasury Department is primarily responsible for enforcing American economic sanctions. A comprehensive sixteen-page complaint, submitted by his legal team, disputes Washington’s determination, characterizing the accusations as lacking sufficient substantiation.

Kabila refutes all allegations

American authorities accuse the former president of extending both financial and logistical aid to the Alliance Fleuve Congo (AFC), a political and military coalition where the M23 is a dominant faction. Furthermore, Washington alleges that he incited Congolese military personnel to desert and resided in Goma, located in the eastern Democratic Republic of Congo, under the M23’s protection. Joseph Kabila unequivocally rejects these claims. His defense contends that the evidence put forth by the US administration is “vague” and “arbitrary,” failing to concretely establish the alleged actions.

Defense demands concrete evidence

Attorneys representing the former president emphasize that the American dossier lacks identification of any specific financial transfers directed to the AFC. They further assert that no Congolese military member has been explicitly named as having been influenced by Joseph Kabila to desert. His defense also highlights that in 2013, during his presidency, the Congolese army played a pivotal role in the defeat of the M23, underscoring a historical inconsistency with current accusations.

Joseph Kabila, who governed the Democratic Republic of Congo from 2001 to 2019, is now petitioning the federal court in Washington to rescind the imposed sanctions and remove his name from the OFAC list.
